Welcome to Waqt. These Terms and Conditions ("Terms") govern your use of the Waqt mobile application ("Waqt", "the App", "we", "our", or "us"). By downloading, installing, or using Waqt, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Waqt is a mindfulness tool that helps you build healthier digital habits. It is not a medical device, therapy substitute, or productivity guarantee — you remain in control of your own usage and decisions.

1. Who Can Use Waqt

You must be at least 13 years old to use Waqt. If you are between 13 and 17, you must have permission from a parent or legal guardian. By using Waqt, you represent that you meet these requirements.

Waqt is an iOS application that helps users create mindful pauses around their social media and app usage. Using Apple's Family Controls, DeviceActivity, and ManagedSettings frameworks, Waqt offers three modes:

We grant you a limited, non-exclusive, non-transferable, revocable license to use Waqt for your personal, non-commercial use on Apple devices you own or control, in accordance with Apple's App Store Terms of Service.

To function, Waqt requires you to grant Family Controls authorization. By granting this authorization, you acknowledge that:

Only interact with Waqt's notifications, pauses, and breathing exercises when it is safe to shift your attention. Never engage with the App while driving, operating machinery, or in any situation where reduced attention could endanger you or others.

7. Not Medical or Therapeutic Advice

Waqt is not a medical device, not a substitute for professional advice, and not designed to diagnose, treat, cure, or prevent any condition. If you are experiencing distress, addiction, or mental health concerns related to digital usage, please consult a qualified healthcare professional.

The breathing exercises, reflective pauses, and notifications offered by Waqt are intended as gentle mindfulness tools and should not be considered therapeutic interventions.

8. Beta and TestFlight Versions

If you access Waqt through Apple's TestFlight program or any pre-release channel, you acknowledge that the App is in a beta or development state, may contain bugs, may not function as intended, and may behave unpredictably with respect to blocking, notifications, and limits. Beta versions are provided strictly for testing purposes and at your own risk. We make no warranty regarding the stability or functionality of any beta release.

9. Disclaimer of Warranties

Waqt is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, fully accurate, or that it will block or limit apps with perfect reliability. App-blocking behavior depends on Apple's Family Controls system and may be affected by iOS updates, device state, system limitations, or other factors outside our control.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Waqt or its developer be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to missed communications, missed notifications, lost productivity, lost opportunities, loss of data, or any harm arising from the App's blocking, pausing, or limiting behavior.

Our total aggregate liability for any claims arising out of or related to these Terms or your use of the App shall not exceed the greater of (a) one hundred U.S. dollars (US$100), or (b) the amount you paid to us, if any, in the twelve (12) months preceding the claim.

You are solely responsible for configuring Waqt appropriately for your needs and for ensuring that critical apps (such as those used for emergencies, work, or communication with dependents) are not unintentionally restricted.

11. Indemnification

You agree to defend, indemnify, and hold harmless Waqt, its developer, and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) your breach of these Terms; (c) your violation of any applicable law or rights of any third party.

12. Intellectual Property

All content, design, code, trademarks, and other intellectual property in Waqt are owned by Cormuss and are protected by applicable copyright and trademark laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

13. Subscription, Auto-Renewal, and Refunds

If Waqt offers paid features or subscriptions, all transactions are processed by Apple through the App Store. The following terms apply:

We reserve the right to suspend or terminate your access to Waqt at any time, with or without notice, for any reason — including breach of these Terms. You may stop using Waqt at any time by uninstalling the App. Upon termination, all licenses granted to you under these Terms will immediately end.

15. Changes to These Terms

We may update these Terms from time to time. Updates will be posted at this URL with a revised "Last Updated" and "Effective Date." Continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, please discontinue use of the App.

Your use of Waqt is also governed by our Privacy Policy, which describes how we handle data. Please review it carefully.

17. Apple-Specific Terms

You acknowledge that these Terms are entered into between you and us only, and not with Apple Inc. ("Apple"). Notwithstanding the foregoing, you acknowledge the following:

These Terms are governed by applicable laws of the jurisdiction in which the developer resides, without regard to its conflict-of-law principles. Any disputes shall be resolved through good-faith negotiation, or, failing that, in the appropriate court of competent jurisdiction. Nothing in these Terms shall limit any consumer rights you may have under mandatory law in your country of residence.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by an enforceable provision that comes closest to the intent of the original.

20. Entire Agreement

These Terms, together with our Privacy Policy and Apple's Standard App Store EULA, constitute the entire agreement between you and us with respect to the App and supersede all prior agreements, communications, or understandings.

21. Waiver

Failure by us to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce that provision or any other provision in the future.
